By making a purchase, or using any of our products, you acknowledge and agree to be bound by these terms of service. If you do not agree with any part of these terms, we kindly request that you refrain from making any purchases through our shop.

Please note that the terms "we," "us," and "our" refer to K Design Co., and the terms "you" and "customer" refer to the individual or entity making a purchase or using our products.

We encourage you to read these terms thoroughly and reach out to us if you have any questions or concerns. These terms are subject to change, and it is your responsibility to review them periodically for any updates or modifications.

Responsibilities for Website Templates

If the customer purchases a website template, they acknowledge and agree to the following:

• Hosting and Showit Account: The customer is solely responsible for purchasing a hosting plan from Showit and maintaining an active Showit account in order to access and use the purchased website template. The customer understands that the website template is designed to be used specifically with Showit and acknowledges that they are responsible for complying with Showit's terms of service and any associated costs.

• Website Domain: The customer acknowledges that they are required to purchase their own website domain separately from a domain registrar or hosting provider. They are solely responsible for acquiring and managing their chosen domain, including renewals, DNS settings, and related technical configurations.

• Supporting Services: The customer acknowledges that they may need to acquire additional supporting services, such as email marketing services or other third-party integrations, to fully implement and customize their website as per their business needs. These supporting services are not included with the purchase of the website template and should be obtained independently by the customer.

• The customer agrees that any issues or difficulties arising from the hosting, Showit account, website domain, or supporting services are their sole responsibility. K Design Co. shall not be held liable for any interruptions, limitations, or disputes related to these services.

Payment Plans and Obligations

• If any products are purchased on a payment plan, the customer agrees to fulfill all payment obligations as specified at the time of purchase. Failure to complete the payments in a timely manner will result in the customer being liable for the full amount owed, plus late fees. Late fees shall be calculated at a compounding rate of 2% per month on the outstanding balance, accruing from 90 days past the due date of the last unfulfilled payment until the date the balance is paid in full.

Sales of Digital Products and Refunds

• All sales of digital products are final. Once a digital product is purchased, no refunds will be given unless explicitly stated otherwise in specific circumstances determined at the sole discretion of K Design Co.. The customer acknowledges that digital products cannot be returned once accessed or delivered, and they are responsible for ensuring compatibility and suitability before making a purchase.

Prohibition of Resale or Redistribution

• Ownership and License: The customer acknowledges and agrees that all website templates provided by K Design Co. are protected by intellectual property rights and are the sole property of K Design Co.. The customer is granted a limited, non-exclusive, non-transferable license to use the purchased website template solely for their own personal or business purposes, in accordance with these terms of service.

• Restriction on Resale or Redistribution: The customer understands and agrees that the purchased website template is strictly for their personal or business use only and may not be resold, redistributed, or made available to any third party without the explicit written consent of K Design Co.. This includes offering the template for free or for any price, whether in its original form or modified.

• Liability for Unauthorized Sales: In the event that K Design Co. discovers, through reasonable means, that a customer has engaged in unauthorized resale or redistribution of the website template, the customer shall be held liable for any and all amounts they have made from such unauthorized sales, whether directly or indirectly. K Design Co. reserves the right to seek legal remedies and pursue damages for any unauthorized use, resale, or redistribution of its website templates.

• Termination of License: Any violation of this clause may result in the immediate termination of the customer's license to use the website template, without prejudice to any other rights or remedies available to K Design Co. under applicable laws.

Credit Link and Affiliate Program

• Affiliate Program: After the purchase of the website template, the customer has the option to participate in the K Design Co affiliate program. By becoming an affiliate, the customer may update the credit link in the footer of the website template to include their unique affiliate link. This enables them to earn commissions on referred sales made through their affiliate link.

• Affiliate Link Compliance: If the customer chooses to become an affiliate and update the credit link, they agree to comply with the terms and conditions of the K Design Co affiliate program. This includes adhering to any guidelines or requirements related to the use and promotion of the affiliate link, as provided by K Design Co.

• Non-Affiliate Customers: Customers who choose not to participate in the K Design Co affiliate program can choose to retain or remove the original credit link to K Design Co. in the footer of the website template.
